1. About This Service

Would You Hold'em Poker ("the Service", "we", "us", "our") is a private, play-money Texas Hold'em poker platform operated for entertainment purposes only. The Service is not a gambling service. No real money is wagered, won, or lost through the Service. All chips and tokens used within the Service have no monetary value and cannot be exchanged, redeemed, transferred, or converted to real money or any item of value under any circumstances.

By accessing or using the Service, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, you must not use the Service.

2. Eligibility

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are 18 years of age or older. The Service is intended for use by a private, invited group of individuals only and is not open to the general public.

3. Nature of the Service — Play Money Only

The Service provides entertainment software only.

• All poker games conducted through the Service use play-money chips with no real-world monetary value.
• No real money is staked, wagered, collected, or distributed through the Service at any time.
• Winning or losing chips within the Service confers no right to any real-world currency, prize, goods, or services.
• The host fee described in Section 4 is a fee for access to the software platform only — it is not an entry fee, rake, or wager of any kind.

The Service is not an interactive gambling service within the meaning of the Interactive Gambling Act 2001 (Cth).

4. Host Platform Fee

To create a game session, the host pays a one-time platform access fee. This fee:

• Covers access to the software platform for the duration of the session only
• Is charged by the operator of this Service as a software service fee
• Is not a bet, wager, rake, prize pool contribution, or gambling payment of any kind
• Is non-refundable once a game session has been activated, except as required by Australian Consumer Law

Session extensions are available at an additional fee, also charged as a software service fee only.

5. Invited Players

Players join the Service via an encrypted invitation link provided by the host. By joining:

• You confirm you are at least 18 years of age
• You confirm you understand this is a play-money entertainment service only
• You agree to these Terms in full

6. Acceptable Use

You agree to use the Service only for lawful, private entertainment purposes. You must not:

• Attempt to exchange, sell, or transfer play-money chips for real money or items of value
• Use the Service in connection with any real-money wagering or gambling activity
• Attempt to reverse engineer, copy, scrape, or extract the software or its data
• Impersonate another person or use another person's account or invitation link
• Use the Service in any manner that could damage, overburden, or impair it
• Attempt to gain unauthorised access to any part of the Service
• Harass, abuse, or threaten other players via the in-game chat or video features
• Use automated scripts, bots, or tools to interact with the Service
• Share or distribute content that is offensive, defamatory, or violates any third party's rights

7. Intellectual Property

All content, software, design, trademarks, and materials comprising the Service are the property of the Service operator. You may not reproduce, copy, distribute, or create derivative works from any part of the Service without prior written consent.

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranty of any kind, express or implied. We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• Any defects will be corrected
• The Service or its server infrastructure are free of harmful components

Your use of the Service is at your sole risk.

9. Limitation of Liability

To the fullest extent permitted by Australian law, the Service operator shall not be liable for any indirect, incidental, special, consequential, or exemplary loss or damage arising from your use of or inability to use the Service. Our total liability to you for any claim arising from your use of the Service shall not exceed the amount you paid for the platform access fee for the session in which the claim arose.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).

10. Session Expiry & Termination

• Game sessions expire at the end of the purchased session period. Session data is held for a limited time after expiry, then permanently deleted.
• We reserve the right to terminate or suspend access to the Service at any time if these Terms are breached.
• We may modify, suspend, or discontinue the Service at any time with or without notice.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains what information we collect and how we use it.

12. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We will indicate the date of the most recent update at the top of this document.
