Would You Hold'em Poker ("the Service", "we", "us", "our") is a private, play-money Texas Hold'em poker platform operated for entertainment purposes only. The Service is not a gambling service. No real money is wagered, won, or lost through the Service. All chips and tokens used within the Service have no monetary value and cannot be exchanged, redeemed, transferred, or converted to real money or any item of value under any circumstances.
By accessing or using the Service, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, you must not use the Service.
You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are 18 years of age or older. The Service is intended for use by a private, invited group of individuals only and is not open to the general public.
The Service provides entertainment software only.
The Service is not an interactive gambling service within the meaning of the Interactive Gambling Act 2001 (Cth).
To create a game session, the host pays a one-time platform access fee. This fee:

All content, software, design, trademarks, and materials comprising the Service are the property of the Service operator. You may not reproduce, copy, distribute, or create derivative works from any part of the Service without prior written consent.
The Service is provided on an "as is" and "as available" basis without warranty of any kind, express or implied. We do not warrant that:
Your use of the Service is at your sole risk.
To the fullest extent permitted by Australian law, the Service operator shall not be liable for any indirect, incidental, special, consequential, or exemplary loss or damage arising from your use of or inability to use the Service. Our total liability to you for any claim arising from your use of the Service shall not exceed the amount you paid for the platform access fee for the session in which the claim arose.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).
Your use of the Service is also governed by our Privacy Policy, which explains what information we collect and how we use it.
These Terms are governed by the laws of Victoria, Australia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We will indicate the date of the most recent update at the top of this document.
